Terms of Service

1. Acceptance of Terms

Welcome to TaxiBuddy. By accessing or using our mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

TaxiBuddy is a personal taxi contact management application that allows users to:

  • Save and organize taxi driver contact information
  • Create and manage routes with associated taxi drivers
  • Rate and review taxi drivers based on personal experiences
  • View aggregated trust statistics for taxi drivers
  • Check taxi driver reliability before adding them to their list

Important: TaxiBuddy is NOT a taxi booking or ride-hailing service. We do not facilitate, arrange, or provide transportation services. We are a contact management tool that helps you organize your existing taxi driver contacts.

3. User Accounts and Registration

3.1 Account Creation

To use TaxiBuddy, you must create an account by providing accurate and complete information, including a valid phone number and username. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Eligibility

You must be at least 13 years old to use TaxiBuddy. By creating an account, you represent and warrant that you meet this age requirement and that all information you provide is accurate and truthful.

3.3 Account Security

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Conduct and Responsibilities

By using TaxiBuddy, you agree to:

  • Provide accurate and truthful information when rating taxi drivers
  • Use the Service only for lawful purposes
  • Not use the Service to harass, abuse, or harm others
  • Not upload or share content that is illegal, offensive, or infringes on others' rights
  • Not attempt to gain unauthorized access to our systems or other users' accounts
  • Not use automated systems (bots, scrapers) to access the Service
  • Not impersonate any person or entity or misrepresent your affiliation
  • Respect the privacy and personal information of other users

5. Content and Intellectual Property

5.1 User Content

You retain ownership of any content you submit to TaxiBuddy (including taxi contact information, ratings, and reviews). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.

5.2 Our Intellectual Property

The Service, including its design, features, graphics, and software, is owned by TaxiBuddy and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

6. Ratings and Reviews

TaxiBuddy allows users to rate and review taxi drivers based on their personal experiences. You acknowledge and agree that:

  • Ratings and reviews reflect individual user opinions and experiences
  • We do not verify the accuracy of user-submitted ratings and reviews
  • Aggregated trust statistics are based on user-submitted data and may not be completely accurate
  • You should use your own judgment when selecting taxi drivers
  • We reserve the right to remove ratings or reviews that violate our policies

7. Disclaimers and Limitations of Liability

7.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Not a Transportation Service

IMPORTANT: TaxiBuddy is NOT a taxi service, ride-hailing platform, or transportation provider. We do not:

  • Employ, contract with, or control taxi drivers
  • Arrange, facilitate, or provide transportation services
  • Guarantee the availability, quality, or safety of any taxi driver
  • Verify the credentials, licenses, or insurance of taxi drivers
  • Assume any responsibility for interactions between users and taxi drivers

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAXIBUDDY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access to or alteration of your data
  • Any interactions with taxi drivers you contact through the Service
  • Any accidents, injuries, or damages arising from taxi rides

8. Indemnification

You agree to indemnify, defend, and hold harmless TaxiBuddy and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Service

9. Third-Party Services and Links

Our Service may contain links to third-party websites or services that are not owned or controlled by TaxiBuddy. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Upon termination, your right to use the Service will immediately cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Eswatini, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the laws of Eswatini.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and TaxiBuddy concerning the Service.
